In the New York Penal Law §135.60 description of coercion, second degree, it says that "A person is guilty of coercion
in the second degree when he or she...expose a secret or publicize an asserted fact, whether true
or false, tending to subject some person to hatred, contempt or ridicule..." With regard
to New York Penal Law §130.65, it says that "A person is guilty of coercion in the first degree when he or she commits
the crime of coercion in the second degree, and when...he or she commits such crime by instilling in the victim a fear that
he or she will cause physical injury to a person or cause damage to property."
In 18 USC §873, blackmail, it says that "Whoever, under a threat of informing, or as a consideration for not
informing, against any violation of any law of the United States, demands or receives any money or other valuable thing, shall
be fined under this title or imprisoned not more than one year, or both."
Did the Daily News and Scott Shifrel "publicize an asserted fact, whether true or false, that subjected me
to hatred, contempt or ridicule?" Yes, they did. The defendants' dishonest public exposure of me as "anti-Semitic"
subjected me to hatred, contempt and ridicule. Their unspoken, but well-acted-upon threat to demand and force my
silence turned my life upside-down. I used to have a friend named Yitzhak who attended a program I use to
attend. After the Daily News and Scott Shifrel published their libelous article about me, Yitzhak and his mother
stopped calling me. FEGS Continuing Day Treatment Program, a Jewish mental health program that I used to attend, ended
my membership. My former social worker, a wonderful woman named Laurie Velcimé who worked at the state psychiatric
facility where I was an inpatient contacted several continuing day treatment programs for me; however, nearly all
the programs that Ms. Velcimé contacted turned me down.
Whether or not I win my lawsuit against these wicked entities, my life will never be the same again. I am always in
fear when I walk into any establishment. I wonder: Is the establishment owned or run by someone Jewish who saw
the defendants' libelous article about me? Will the non-Jewish employees of an establishment I visit scorn me because
of the libelous news article that was published about me -- and seen by their Jewish boss? Will the Jewish
community, in its perverted loyalty to fellow Semite Scott Shifrel, find some way to hurt me again -- or maybe
even kill me? While I put on my usual happy face, I am angry, afraid or both all the time.
The Daily News' and Scott Shifrel's use of "anti-Semitism" did
not just hurt me. It also took advantage of the Jewish community's justified fear of anti-Semitism and used
it as a shield to protect corrupt attorneys Allen E. Kaye, Harvey Shapiro, Bernard Rostanski and Jack Gladstein by stopping
me from continuing with the lawsuit I filed against them -- something that is taught in the Euro-Jewish faith.
That's right, Scott Shifrel's primary reason for publishing the Daily News' libelous article about me was to
protect fellow Talmud adherents Allen, Harvey, Bernard and Jack from my legal onslaught. However, it now appears that
in their haste to protect those corrupt attorneys, the Daily News and Scott Shifrel forget to protect themselves.
Now they cannot protect those wicked attorneys -- or themselves.
Thirty days have passed since the Daily News and Scott Shifrel received my lawsuit. It is 5:00 p.m.; the mailman
has come and gone and I have not received the defendants' answer and response to my Verified Complaint and Notice to Admit. At first, I fearfully considered the possibility that the defendants might allow 29 days to pass without
serving me with their answer and response, then pull an uncomfortable surprise on me and serve me with the legal papers on
the 30th day; but I don't have to worry about that anymore. By operation of law -- specifically, CPLR Rule §3212, summary judgment, CPLR §3215, default judgment and NYCRR §202.27, the defendants have defaulted. Of course now, I have to wonder if Judge Parga might emulate his
judicial predecessors and render a decision that violates the law, but for now, that's only a supposition. At
least I have the comfort of knowing that the defendants -- under the weight of truth and law, buckled like a drunken slut.
In the meantime, make no mistake about it.
Defendants Daily News, LP and Scott Shifrel are more than just wicked entities, driven by the misapplication of religious
tenets that few understand, or even know.
They are felons.
